2015 December 10, Kathmandu. On 10th December, Nepal Police have foiled a peaceful interaction program in Sarlahi district and have arrested more than a dozen of Madheshi activists, including Kailash Mahato, the sub-coordinator of the Alliance for Independent Madhesh, the chief guest for the program. The arrested people include Dharma Lal Ray, Hridaya Narayan Chaudhari, Suresh Yadav, Upendra Yadav, Naresh Kushwaha, Rabindra Kumar Mandal, Arvind Jha, Akhleshwar Raut, Upendra Raut and Ram Vilas P Sah. The police used force and threat to disperse the gathered mass of about three hundred people, and vandalised the program venue. 

Similarly, on 7th December, Nepal Police arrested Roshan Sah, the proprietor of the Ashutosh Printing Press from the Patan Industrial Area in Kathmandu on the accusation of “printing pamphlets with Buddha Gandhi and Mandela on its cover and biography of Dr. C. K. Raut on its back.”[1] Police have filed a public offence charge against him. He is still under custody. 

Likewise, among the four activists detained on 24th November, while they were holding a meeting in Bariyarpur of Bara district to commemorate November 26th as ‘the Racial Arrest Day’, through peaceful placard demonstrations,  Brajesh Singh and Sadam Ansari have been sent to prison in Birgunj for pre-trial detention, with a clear motivation to torture them. Police have filed a fake charge against all of them, namely Brajesh Singh, Sadam Ansari, Binod Sarraf and Bitu Sah. On 24th November, before arresting them, the police had locked about 30 participants inside the meeting room inhumanly [2].

On 26th November, Nepal Police arrested more than a hundred activists of the Alliance for Independent Madhesh (AIM) led by Dr. C. K. Raut, from various districts, while they were demonstrating to mark the Sundhara Racial Arrest of 2014.  The police arrested 31 activists from Kathmandu, protesting in front of the United Nations building to submit a memorandum, 34 from Siraha, 24 from Rauthat, 4 from Bara, and one from Parsa district [3]. The police used force in Biratnagar and Lahan, injuring about half a dozen of activists, and seizing loudspeakers and two bicycles. However, all of them were released later, after keeping three dozen of them for a night, subjecting them to mental torture using coercion and threats. The Alliance had decided to commemorate November 26th as ‘the Racial Arrest Day’, through peaceful placard demonstrations, to mark the arrest of more than 300 Madheshis one year ago on the same day, from the Sundhara area of Kathmandu, when the Nepal Police had arrested them just by looking at the colour of their skin (See, Amnesty International Appeal [4], Asian Human Rights Commission Report [5]).

Alliance for Independent Madhesh (AIM) condemns such undemocratic and cowardly acts of Nepal Police. Alliance for Independent Madhesh (AIM) is a coalition of Madheshi people, activists, political parties and various social organisations working for the independence of Madhesh, through non-violent and peaceful means following the principles of Buddha, Gandhi and Mandela. The alliance advocates an end to Nepali colonisation, racism, slavery and discrimination imposed on the Madheshis. It stands for three pillars: (a) Independent Madhesh (b) Democratic System, and (c) Peaceful and Non-violent Means.

Acknowledging that the rights to freedom of speech, movement, peaceful assembly and association are the fundamental rights of all human beings everywhere, as also mandated by the United Nations Universal Declaration of Human Rights (UDHR) and International Covenant on Civil and Political Rights (ICCPR), of which Nepal is a signatory, we expect acknowledgement and assurance of the rights to freedom of expression, movement and peaceful assembly from the state and its agencies. We hereby appeal to all human rights bodies, journalists and international communities to oppose any infringement on fundamental human rights by the Government of Nepal and its agencies, to secure immediate and unconditional release of the detainees, and to ensure fundamental human rights and freedom of expression for all.

मानवअधिकार दिवसको दिन सर्लाहीमा गठबंधनका केन्द्रिय उपसंयोजक सहित एक दर्जन भन्दा बढी गिरफ्तार;
नेपाल प्रहरीको दमन बढदो

मंसीर २४ गते बिहीबार सर्लाहीको मलंगवामा गठबन्धनले समसामयिक राजनैतिक विषयमा अन्तरक्रिया कार्यक्रम गर्न लाग्दा नेपाल प्रहरीले बल प्रयोग गरेर सो कार्यक्रम बिथोल्नुका साथै गठबन्धनका उपसंयोजक कैलाश महतो सहित एक दर्जन भन्दा बढी कार्यकर्ताहरूलाई गिरफ्तार गरेको छ। पक्राऊ पर्नेहरूमा धर्मलाल राय, हृदयनारायण चौधरी, सुरेश यादव,  उपेन्द्र यादव, नरेश कुशवाहा, रबीन्द्र कुमार मंडल, अरबिन्द झा, अखलेश्वर राउत, उपेन्द्र राउत र रामविलास साह समेत रहेका छन्।  बन्दुक बोकेर आएका सशस्त्र प्रहरीले बल प्रयोग गर्दै र धम्काउँदै  करीब तीन सय सहभागीलाई तितरवितर गरेको थियो र कार्यक्रम स्थलमा तोडफोड गर्नुका साथै ब्यानर समेत खोलेर लगेको थियो। 

यस अघि मंसीर २१ गते सोमबार,  ललितपुरको पाटन औद्योगिक क्षेत्र भित्रबाट आशुतोष प्रिन्टिंग प्रेसका मालिक रोशन साहलाई नेपाल प्रहरीले "बुद्ध, गांधी र मंडेलाको तस्वीर अगाडिको गातामा तथा डा. सी. के. राउतको परिचय पछाडिको गातामा रहेको" गठबन्धनको पर्चा छापेको अभियोगमा गिरफ्तार गरेको थियो। साहलाई स्थानीय प्रशासनले सार्वजनिक मुद्दाको कारबाही अगाडी बढाएर हिरासतमै यातनापूर्वक राखिएको छ। 

त्यसैगरी, मंसीर ८ गते बाराको बरियारपूरबाट 'मंसीर १० गतेको रंगभेदी गिरफ्तारीको वार्षिकी मनाउने' कार्यक्रमको विषयमा बैठक गरिरहेको बेलामा ब्रजेश कुमार सिंह, सदाम अंसारी, विनोद शर्राफ र बिटू साहलाई गिरफ्तार गरेका थिए। उनीहरु चारै जनामाथि झूठा खरखजाना ऐनको मुद्दा चलाइएको छ। ब्रजेश कुमार सिंह र सदाम अंसारीलाई पुर्पक्षका लागि वीरगंज कारागारमा पठाइएको छ, भने बाँकी दुई जनालाई हिरासत मुक्त गरिएको छ।

स्मरण रहोस्, मंसीर १० गतेको रंगभेदी गिरफ्तारीको वार्षिकी मनाउने क्रममा विभिन्न जिल्लाबाट नेपाल प्रहरीले १०० भन्दा बढी प्रदर्शनकारीलाई गिरफ्तार गरेको थियो। काठमाडौंमा संयुक्त राष्ट्रसंघको भवन अगाडिबाट ३१, सिरहाबाट ३४, रौतहटबाट २४, बाराबाट ४ र पर्साबाट १ जनालाई गिरफ्तार गरिएको थियो। विराटनगर र लहानमा प्रहरीले बल प्रयोग गर्दा शांतिपूर्ण प्रदर्शन गरिरहेका करीब आधा दर्जन कार्यकर्ताहरू घाइते भएका थिए। २०७१ साल मंसीर १० गते नेपाल सरकारले काठमाडौंको सुन्धारा क्षेत्रबाट ३०० भन्दा बढी मधेशीहरुलाई छालाको रंग देखेरै गिरफ्तार गरेको घटनाको अवसरमा गठबन्धनले विभिन्न जिल्लाहरूमा यही मंसीर १० गते प्लाकार्ड सहित शांतिपूर्ण प्रदर्शन गर्दै 'रंगभेदी गिरफ्तारीको वार्षिकी' मनाउने निर्णय गरेको थियो। 

गठबंधनको शांतिपूर्ण विचारमूलक अन्तरक्रिया कार्यक्रमहरूलाई समेत नेपाल प्रहरीले बन्दुकको बलमा बिथोल्ने र नेपाल सरकारद्वारा गठबंधनका कार्यकर्ताहरुमाथि चरम दमन गर्दै झुठा मुद्दा लगाएर फसाउने घृणित कार्यको हामी घोर भर्त्सना गर्दछौं, र सम्पूर्ण पत्रकार, मानवअधिकारकर्मी तथा अन्तर्राष्ट्रिय समुदायलाई नेपाल सरकारद्वारा गरिएको यस कुकृत्यको विरोधमा सशक्त आवाज उठाई दिनुहुन विनम्र अनुरोध गर्दछौं। 

शांतिपूर्ण रुपले प्रदर्शन गर्दा समेत नेपाल प्रहरीद्वारा गरिएको यस गिरफ्तारीको गठबन्धन घोर-भर्त्सना गर्दछ र सम्पूर्ण पत्रकार, मानवअधिकारकर्मी तथा अन्तर्राष्ट्रिय समुदायलाई नेपाल सरकारद्वारा गरिएको यस कुकृत्यको विरोधमा सशक्त आवाज उठाई दिनुहुन विनम्र अनुरोध गर्दछ।
